Attorneys Brian Kabateck and Shant Karnikian break down what CREW called "one of the single most corrupt acts in American history." Trump dropped his $10 billion IRS lawsuit and in exchange, the DOJ created a $1.776 billion "Anti-Weaponization Fund" to compensate allies who claim they were unfairly targeted by the Biden administration. The money comes from the federal Judgment Fund, a permanent Treasury appropriation funded by taxpayers. A five-member commission appointed by Acting AG Todd Blanche, with members removable by Trump, will distribute the money with no congressional vote, no judicial oversight, and no published eligibility criteria. January 6 rioters who were pardoned could submit claims. Trump, his sons, and the Trump Organization receive a formal apology but no direct payout, a fig leaf Brian and Shant call transparently absurd. The Treasury Department's top lawyer, a Senate-confirmed Trump appointee, resigned over the deal. House Democrats filed a motion calling it "pure fraud and highway robbery." Brian and Shant outline four legal challenges: Article III requires an actual case or controversy, the Emoluments Clause bars self-dealing, the APA requires proper administrative procedures, and only Congress has power of the purse. The Treasury has 60 days to move the money, and the structure was designed to outrun any legal challenge.
