On June 4, 2026, Rep. Lloyd Doggett (D-TX) questioned Treasury Secretary Scott Bessent at the House Ways and Means Committee. It was Bessent's second consecutive day of testimony — the day before at Senate Finance, he had refused to answer the same questions on Trump's IRS settlement.
Doggett opened with a question about history, not litigation. Has the IRS ever recommended that any taxpayer be granted immunity from a tax audit? The settlement, signed by acting Attorney General Todd Blanche — Trump's former personal criminal defense attorney — resolved Trump's $10 billion lawsuit against the IRS over the 2020 data breach. The deal grants Trump and his family permanent immunity from IRS audits. The attorney general cannot compromise a tax dispute unless the IRS refers it. Doggett asked whether Bessent was involved in that referral. Bessent refused to answer.
Brian Marcy, the Senate-confirmed Treasury General Counsel, resigned rather than be associated with the deal. Career IRS employees wrote a 25-page memo asking the Justice Department to halt it. Doggett asked Bessent to pledge no retaliation against those employees. Bessent: "We always follow the law."
Doggett then raised the May 18th technical issue. The settlement bars the IRS from raising any claims on returns filed before May 19, 2026. He presented a scenario: if Trump had filed an amended return on May 18th claiming a $10 billion refund, would the settlement require Treasury to pay it with no questions asked? Bessent would not answer.
