On June 4, 2026, Rep. Linda Sánchez (D-CA) — a practicing attorney — questioned Treasury Secretary Scott Bessent at the House Ways and Means Committee and dismantled his two-day excuse for refusing to answer questions about Trump's IRS audit immunity.
BESSENT'S EXCUSE — "ONGOING LITIGATION": For two consecutive days of congressional testimony, Bessent had refused to answer any questions about the Trump/IRS settlement's audit immunity provision by citing "ongoing litigation." Sánchez, as an attorney, systematically dismantled that excuse in three steps.
STEP 1 — CAN YOU NAME THE CASE?: After getting Bessent to confirm on the record that all Americans should follow tax laws, that people who lie on returns should be audited, and that tax law breakers should be held accountable, Sánchez asked directly: "Why is President Trump allowed to have complete immunity from being audited?" Bessent cited ongoing litigation. Sánchez asked him to name the ongoing case. He couldn't. He said he'd get back to her because he's not a lawyer.
STEP 2 — SÁNCHEZ NAMES IT HERSELF: Sánchez identified the only relevant litigation herself — Floyd v. Department of Justice. She entered the judge's actual ruling into the committee record. That ruling only addresses the Anti-Weaponization Fund, which had already been suspended. It does not address Trump's IRS audit immunity at all. The legal shield Bessent had been hiding behind doesn't cover the thing he was refusing to discuss.
STEP 3 — THE 1962 SUPREME COURT PRECEDENT: "I know that since 1962, the Supreme Court has held that ongoing litigation does not prevent someone from testifying in a congressional hearing." Bessent's excuse was factually wrong about which cases existed and legally wrong about whether those cases permitted his silence.
THE BIDEN HYPOTHETICAL: Sánchez asked: if President Biden had amended a prior tax return and claimed he was owed $1 billion, would that be audited? Should it be? Bessent wouldn't answer. She then asked who counts as Trump's "family" for the purposes of the immunity — his children, in-laws, grandchildren, distant cousins? Bessent: "I imagine you have the Justice Department phone number. I suggest you call them."
CLOSING: "I think it's pretty safe to say that this is probably the most corrupt Treasury Department in our nation's history. And while you dance around questions to protect Trump, Americans are suffering in Trump's spiraling economy. Inflation is now rising faster than average hourly wages. Gas prices are at an all-time high with the war in Iran. The cost of groceries has risen 3.2%."
Bessent's response when given time to reply: "The congresswoman is slanderous. She has nothing but unsubstantiated opinions. I will not stand for that!" He named no case. He answered neither the Biden question nor the family definition. His rebuttal to a lawyer who cited a Supreme Court precedent and a specific court order was one word: slanderous.
